State shuts down Spokane day care - News Story - KXLY Spokane
I'd like more information from the Department of Early Learning (DEL) on this Spokane child day care provider and facility.
This from the linked article (bold is mine):
"State officials repeatedly cited Berland for violations that included allegations that a staff member "threw a child to the floor" in 2002, a child was unsupervised and left the facility without the child care filing a report; garbage, including human feces, was within children's reach and hadn't been emptied in three weeks; and the children were not properly disciplined or, on other occasions, comforted by staff members."
Now is the time for DEL managers to become clear and transparent; and own any past mistakes so that when the new regulations are implemented in March 2012 everyone starts with a clean slate. That tendency of DSHS and DEL to cover up their mistakes must stop or it will devolve back to its managers' risky behaviors.
"threw a child to the floor" in 2002. That's like almost ten years ago. What did that episode look like? What specifically does that mean? If children don't get maimed or dead from being thrown to the floor, the provider gets to keep her license? We need more information here. Two years after this reported incident is when Spokane day care provider Danette Zaring "threw" two year old Hailee Rhodes to the floor. Is Zaring out of prison yet?
If DEL is taking steps now to protect children and follow RCW 43.215.005(4)(c) then kudos to them. The Washington State Supreme Court affirmed in July 2011 that the legislature's "intent" indeed was that health, safety and well-being of the child is paramount over a person thinking they had a right to a license.
Perhaps with the Washington State Supreme Court weighing in DEL will follow that law, but one has to be suspicious since DEL has not been obeying RCW 43.215.370 that got passed in 2007. I've posted an email from the Attorney General's Office that showed the AGO advised DEL, yes, you "shall", it's a must; you "shall" post revocation, suspension and denial information on your website.
DEL hasn't been doing that now for almost five years. If DEL managers remain in a state of mind that they will pick and choose which Washington State laws to obey or not, the risk factor is still there.
I've been posting information here via my blog to get out what I can to the public and to parents in Washington State.

Suspensions of Child Day Care Licenses in Washington State - A Sample of the Problems that can Occur in Licensed Day Care
Through making a public disclosure request (which all parents have a right to do) from the Department of Early Learning in Washington State I received a spreadsheet on the 70 licensed day care providers and centers who were suspended in the time frame of July 13, 2010 to June 1, 2011.
Just to give you an idea of what kind of problems I saw as a licensor and what kinds of problems were seen in this one year period of time in Washington State in licensed day care I've copied in below just those factors.
I apologize for not having time to clean up the document information from copying it off of a spreadsheet, but wanted to get as much information out to parents as I can to give you perhaps a heads up on the issues that can come up in licensed child day care in Washington State. Other states have a similar pattern.
The Department of Early Learning is required by law (passed in 2007 by the Washington State legislature) to post this information on their website. DEL's unelected bureaucratic managers will not obey this law.

"DSHS has become an agency of state government in which fraud and mismanagement are commonplace; where layers upon layers of managers and bean-counters feed off the lifeblood of taxpayers while building their fiefdoms and management silos to hide their shame."
DSHS was created in 1970. One of the creators Marilyn Ward wrote in 1976 that it almost immediately began to fail. We live yet with that failure. Well some didn't live...children. Now 42 years later....
We shall see what candidates for governor, Attorney General, Rob McKenna and Congressman, Jay Inslee are going to do in the campaign season about this state government agency. In their opening campaigns speeches they each only devoted about 12% to the problems of state government.
It is about the management. DSHS claiming it's about the money is not true.

DSHS - DEL - Hiding Information from Parents even after Attorney General's Office Said "Post it"
In Washington State for that last four years the Department of Early Learning (DEL) has refused to comply with a law the legislature passed in 2007, RCW 43.215.370.
See the email message below that I got through public disclosure from assistant attorney general (AAG) Grace O'Connor that the law is a "shall" and DEL must comply. The AAG copied the law into the email.
I highlighted that AAG's comments to DEL Service Area Manager, Josh Verville in Blue Text.

Your second question is whether DEL is statutorily mandated to post specific licensing actions on LCCIS—that is, whether you must post “valid for suspension” or if you can just post “valid.” The following language is from a new DEL bill, which became effective July 2007 (Engrossed substitute senate bill 5317):
NEW SECTION. Sec. 9. REPORTING ACTIONS--POSTING ON WEB SITE. For the purposes of reporting actions taken against agency licensees, upon the development of an early learning information system, the following actions shall be posted to the department's web site accessible by the public: Suspension, surrender, revocation, denial, stayed suspension, or reinstatement of a license.
This seems to indicate that some kind of web posting is statutorily mandated (note the use of “shall”), though it doesn’t appear that you must use LCCIS to do so. That is, as long as the information is easily accessible somewhere on DEL’s website, it needn’t be exclusively provided through LCCIS (though it might make the most sense, of course, to post these types of things via LCCIS). In addition, it also appears that DEL must identify the type of action at issue – so simply saying there was a valid action without specifying what type of action occurred might run afoul of this provision.
Your third question was whether DEL is obligated to take action against unlicensed providers. This question can also be restated as: could DEL be liable for a failure to take action against an unlicensed provider? This is a somewhat more complicated question than the previous one. I can tell you that so far my short answer to that question is probably not, but I am still looking into it, and will have something to you by early afternoon tomorrow (Wednesday). I just wanted to send Question #2 along so you could have it as you begin putting together your points for Jone.

DSHS - DEL - Hiding Child Day Care Information - This from the Tacoma Office
I got this information through a public disclosure request. I post this information for parents to get an idea of what was going on in some licensed child day child facilities from 1979 to 2011 in this case out of the Tacoma, Washington office in the Department of Early Learning (DEL).
Since DEL refuses to comply with the law (RCW 43.215.370) to post revocation, denial and suspension information on my blog when I get such information I post it to help parents, grandparents and public citizens who care about the health, safety and well-being of our children in licensed day care.
I attached the names of the managers at the times these licenses were suspended, revoked and/or denied.
The column "What was the tipping point?' I tried to distill at least some of the major issues. Most of the time the record didn't get me the information as to how long the licensed provider had a license before the license was revoked.
There appears to be a BIG gap from 1988 to 1996 in terms of taking any enforcement actions at all.
I copied from an Excel spreadsheet and hope it copies over well enough to read.

Since DEL refuses to comply with the law (RCW 43.215.370) to post revocation, denial and suspension information on my blog when I get such information I post it to help parents, grandparents and public citizens who care about the health, safety and well-being of our children in licensed day care.
I attached the names of the managers at the times these licenses were suspended, revoked and/or denied.
The column "What was the tipping point?' I tried to distill at least some of the major issues. Most of the time the record didn't get me the information as to how long the licensed provider had a license before the license was revoked.
There appears to be a BIG gap from 1988 to 1996 in terms of taking any enforcement actions at all.
I copied from an Excel spreadsheet and hope it copies over well enough to read.
