Day Care Provider passed out in van with little ones

Yacolt Family Home Child Care provider was passed out in her mini-van with 2 day care children one 2 years old, the other 16 months old.

Sheila Michalios was cited in July 2010 for violation regarding the WAC related to alcohol. She also had a valid complaint regarding violations related to her business records.

King 5 posted the story. See their link below for full story.

BATTLE GROUND, Wash. -- A Yacolt, Wash. day care provider was arrested Friday after police said she passed out while two children were in a minivan with her.

Battle Ground Police said officers found Sheila Michalios, 45, unconscious in her minivan at around 5:45 p.m. in the 500 block of E. Main Street and was unable to care for the two small children who were with her. The children -- a 2-year-old boy and his 16-month-old sister -- were in their car seats, but they weren't properly buckled in. Police found open alcohol containers in the minivan and said Michalios smelled of beer.

I'm blogging about it now because the Department of Early Learning when they move to revoke a license takes the provider's name off their website in violation of RCW to inform parents.

I'm copying it in here if they move to revoke this license so parents will not be prevented from having the public information that is the right of the citizens of Washington state to have.

There could be other complaints, the DEL website only identifies complaints AFTER JULY 25, 2005.

Copied below is the information available off the Department of Early Learning (DEL) website, today, October 30, 2010.

Marilyn Van Derbur Once Can Hurt a Lifetime

For parents one of the most powerful voices you can hear to understand what sexual violation can do to young children and how you can empower yourselves to protect and empower your children are the words of Marilyn Van Derbur.

Type in MissAmericabyDay.com to go to her website.

Marilyn was a 1958 Miss America and her wealthy father violated her from age 5 to age 18. Her older sister was also violated.

Marilyn's memoir came out in 2004; and included in the book is a plethora of stats and resources; again that will be empowering. I suggest getting her DVD, she is a powerful motivational speaker, her words, her humor, her presence will bring comfort via her truthtelling.

Day 2 of Request for Department of Early Learning to comply with RCW 43.215.370

I posted this yesterday on my website. I'm awaiting word back from the Governor, State Auditor and Attorney General.

Diane Fletch's day care as of this morning viewing the Department of Early Learning website does not show she has a license; and there is still no information about her summary suspension.

Department of Early Learning - hiding vital information from Parents
The Diane Fletch licensed family home child care in Vancouver, Washington where an outbreak of e-coli began on March 12, 2010 which resulted in the death of 4 year old Roanan is no longer listed on the Department of Early Learning website.

7 out of 17 in the facility tested positive for e-coli. Four children were hospitalized. 4 year old Roanan died on April 8, 2010.

Diane and Larry Fletch told the Health Department and the Department of Early Learning they voluntarily closed their facility in March 2010 and would not until certified by the Health Department to re-open.

It was learned the Fletch's provided child care on April 6, 2010.

This family home child day care facility had a history of violating the capacity regulations as well as other health and safety regulations. They had been issued at least 2 civil penalty fine letters in their history.

The Department of Early Learning after becoming aware the Fletch's provided care only sent them a summary suspension letter. Why is it not a summary revocation?

Plus the RCW below became law in 2007 and has never been complied with by the Department of Early Learning:

"RCW 43.215.370
Reporting actions against agency licensees — Posting on web site.

For the purposes of reporting actions taken against agency licensees, upon the development of an early learning information system, the following actions shall be posted to the department's web site accessible by the public: Suspension, surrender, revocation, denial, stayed suspension, or reinstatement of a license."

The public has a right to know about this licensed child day care facility as well as other facilities where children were put at risk.

I'm sending my Eye on Government report to Governor Christine Gregoire, State Auditor Brian Sonntag, Attorney General Rob McKenna and Director of the Children and Family Ombudsman's Office, Mary Meinig to see if anyone of them can get the Department of Early Learning to follow RCW 43.215.370. Or at least find out why they haven't since 2007.

I'll ask them to get back to me.
