OK, this is an open letter to the Department of Early Learning (DEL), to the director Betty Hyde, to governor Christine Gregoire (Betty's boss) and to attorney general, Rob McKenna of the State of Washington.

Dear Betty, Christine and Rob,

It is December 1, 2011 and DEL summarily suspended the family home child day care provider, Laura Clarice Martin's license on or about November 24, 2011. The law requires you to put this information on the DEL website per RCW 43.215.370; right where you have the other information written in RED. As of today you have not done so even though I was told by a DEL employee that you would:

I am about ready to contact the Guinness Book of World Records and submit a proposal to see what state government child day care licensing agency has taken the longest to implement a law passed by their citizen legislature.

For RCW 43.215.370 Christine Gregoire, Betty Hyde and Rob McKenna it has been four going on five years since the law was enacted by our citizen legislature. See where that RED sentence is up above? All you have to do is type in "summarily suspended".

Go ahead. Give it a shot. You can do it. Give it a whirl. We're all behind you. We will all say thank you for adding the vital information for parents to know.

Provider is currently summarily suspended.

Just those five words. Come on, show the citizens of the state of Washington that our high level elected government officials obey the law.

Or maybe I should send my pleading to Stephen Colbert, Bill O'Reilly and Jon Stewart; and ask them to give you a call about why you can't type those five words into the DEL website per the law, RCW 43.215.370.

Like Carrie Fisher (Princess Leia from Star Wars) wrote in her memoir Wishful Drinking, "If this wasn't funny it would just be true." 

Christine, Rob and Betty I'm pulling for you. I'm just waiting to say thank you for being high elected government officials and Betty, for being an appointed official who has taken action with integrity, that our leaders are obeying a very simple to implement law.

Washington State Auditor Brian Sonntag Finishes Investigating Some of My Whistleblower Complaints 5 Years Later

I made numerous whistle blower reports in 2005 to State Auditor Brian Sonntag through his whistle blower program. Sonntag initiated an investigation in February 2005 then abruptly stopped from completing the started investigation in May 2005.

In May 2005 I made additional whistleblower reports regarding the "shall" in RCW 74.15.030(2)(3) which means the department must complete background investigations. I had a thick pile of "character, competence and suitability" background clearance forms to submit for his investigation. In February 2005, the auditor's office asked for my documents and I delivered them. By May, 2005 they didn't and stopped the investigation.

I continued making whistleblower reports into August 2005. I now have acquired an email from August 2005 written by DSHS Secretary Robin Arnold-Williams where she stated she wanted my whistleblower complaints made on August 2, 2005 investigated and wondered if the State Auditor's Office would so. They did not.

A partial investigation was done from August 2005 to December 2005 with the DSHS employees out of the Southwest Washington region, the Vancouver Office. Before the DSHS "investigators" began their investigations, they promised supervisor, Darcy Taylor and the employees she supervised that no matter what was revealed to them in the course of their "investigation" no discipline or retaliation would occur from answering their questions. Even though it was a poorly done investigation the investigators did find problems. No discipline resulted.

Representative Ross Hunter and his Aide Marilyn Pedersen requested copies of the documents I sent to the State Auditor's Office.

In addition, I sent them copies of the documents that showed the Vancouver Office was ignoring serious and concerning background information, failing to complete their duties as required under RCW 74.15.030(2)(3). With their review, Rep Hunter wrote Brian Sonntag a letter expressing great concern about some of these applicants being approved to have contact with children.

Instead of Brian Sonntag then deciding to complete the investigation he started, the whistle blower reports became a hot potato and he threw the "investigation" over to Mary Meinig, the director, at the Office of Children and Family Ombudsman (OCFO )where they lanquished for five years and then Meinig wrote a letter stating her office didn't have the authority to investigate.

As I've shared previously with the public that office created in 1996 was transparent and the child death reviews actually mentioned that DSHS had managers and supervisors. Not many years later by reading the child death reports you would not know that DSHS had managers. Then somebody created a law that no one can see the documents OCFO used in their child death investigations, NOT EVEN THE COURTS IN THE STATE OF WASHINGTON.

I was encouraged by legislators I testified to in February 2005 (including chair, Rep. Ruth Kagi) to make whistleblower reports. I personally handed to Rep. Kagi that day in February 2005 copies of records that had been removed from a licensing file in 2002. Through an new office duty I had been given this discovery came to may attention.

In January 2004 two year old Hailee Rhoades had been slammed down in her playpen by licensed family home provider Danette Zaring in Spokane and received permanent brain damage. In April 2004, a little boy was run over by a car in the driveway of Vancouver unlicensed daycare provider Minnie Jones (her licensor was ordered to act as though she still had a license when she didn't), by June another little boy drowned in the Tacoma area and DSHS hit my tipping point as author Malcolm Gladwell calls it.

I went outside the agency and ended up on a special King 5 News Investigators report on licensed daycare and why it took so long in a third of the revocations letters they reviewed to revoke a license. By February 2005 I make more whistle blower reports as well as writing open emails to anyone and everyone I could think of in state government and Boeing to call for the whistle blower investigations to be completed.

No one but Rep. Ross Hunter stepped forward to directly take on the issue of protecting your children while you are away at work, praying that your children are being treated with love and kindness let alone still be alive when you pick them up.

By December 1, 2005, nine months later, eighteen month old Jaclyn Frank died in the Julie Norris licensed family home daycare in the Seattle area.

Five years later KREM television station in Spokane, Washington reported:


"The state auditor’s office based their research in Southwest Washington. Investigators were following up on earlier issues with DEL dating back to 2003. Of the 17 daycare centers visited, 13 did not finish background checks and DEL staff could not verify that even half of the checks were done."

The State Auditor focused their audit in the Southwest Washington because I wouldn't quit, I wouldn't shut up and wouldn't give up even when DSHS fired me in 2006. Instead I became a small business person, an entrepreneur, an analyst, researcher and expert witness to help folks get some measure of justice.

While children's safety and protection comes first, I have also assisted licensed daycare providers who were being dealt with unjustly by the state child care licensing agency by whatever name you call them. After too many children die and the media puts too much attention on those deaths, the bureaucracy changes its name and hires another director that knows little or nothing about daycare licensing.

I've told State Auditor Brian Sonntag, Governor Christine Gregoire and Attorney General Rob McKenna I am looking for some heroes and that it is never too late to be that hero. When the newest named daycare licensing agency came into being, the Department of Early Learning (DEL) I consulted pro bono with Southwest Area Manager, Josh Verville to assist the new agency by giving them my historical knowledge and expertise.

I'm available to discuss with both candidates for Governor, Rob McKenna and Jay Inslee, Congressman, about  daycare licensing to share my history, knowledge and experience so both can build into their platforms the protection of children.

As Washington State Wire analyzed, both candidates devoted only about 12% of their announcement campaign speeches to the problems of state government.

I've stopped by Brian Sonntag's Office and was treated very respectfully, however, my message I left, to request a meeting with him to help improve the whistleblower program has not been responded to by him.

A thank you to Brian Sonntag for doing that background clearance audit on DEL in Southwest Washington in 2010 even if it was five years after I first made those whistle blower reports to him. In 2006, Kim Hurley, in his office upon meeting me wanted to immediately hire me because of my knowledge about the "character, competence and suitability" piece of the background clearance process; to help out with that audit that had originally been set to be done in 2006.

As George Bush might say, Who were the "deciders" back in May 2005 that stopped State Auditor Brian Sonntag from completing his investigations he started on my numerous whistle blower reports?

Who had the power to stop the whistleblower investigation...dead in its tracks?

Governor Gregoire Hiding Public Records-Refusal to Release Public Records

In the linked article below written by Erick Smith, reporter for Washington State Wire regarding Governor Gregoire not releasing public records and making comparisons with former president Richard Nixon was an eye opener to this former DSHS social worker/public disclosure coordinator and off and on whistle blower during my more than 20 years inside the state government bureaucracy.

I appreciate the non-partisan reporting by this...what looks to be a fully on line newspaper...so to speak. The article caught my attention when it mentioned the Freedom Foundation, as recently I came across an excel spreadsheet on line created by the Freedom Foundation in March 2009 with my name on it (Margo Logan).

The spreadsheet shows that four emails I had written to the Governor regarding SEIU 925 related to the so-called 2009 collective bargaining bills which was once more making its way through the state House and Senate that year were withheld from the Freedom Foundation's public disclosure request.

Those emails were and are wholly public records and, indeed, had been written as open letters (emails) not only to the governor, but also to senators and representatives on both sides of the aisle.

I made whistle blower reports in 2005 and testified to Rep. Ruth Kagi's children's committee about DSHS managers hiding, concealing, ordering public records altered whereby the managers then had the originals destroyed. I gave Rep. Kagi a copy of a packet of background clearance documents I found in a notebook in the office and testified those documents had been removed from a licensing file.

I made this report not only to the State Auditor, Brian Sonntag, but up the DSHS chain of command to DSHS Secretary Robin Arnold-Williams to Governor Gregoire and to Attorney General Rob McKenna.

DSHS child care licensing supervisor Lzady Culver in 2005 (and still a supervisor today in the Department of Early Learning) emailed me that the Attorney General's Office didn't want emails put into licensing files. I replied back, why? Culver wrote it was so our computers would not be subpenaed. My reply was why would it matter...it is all public business and public records.

I can't tell from Washington State Wire article if my four 2009 emails will be going to the Washington State Supreme Court as part of this legal issue. If so, I am willing to submit an affidavit as a former DSHS public disclosure coordinator and now private analyst/consultant/expert witness that withholding my four emails was in violation of the public records act.

See my other blog entries on SEIU to give you the history I researched as well as experienced with AFSCME and SEIU.

The government of the people, by the people and for the people is the focus government must have whether they are elected officials or unelected bureaucratic managers.

The amount of work, from my experience and opinion, that could get done within these bureaucracies would be amazing if they weren't so focused on covering up some of their work product.

To the Governor: Please release my four 2009 SEIU emails to the Freedom Foundation.

State Rep. Ruth Kagi and the Manson Family

No, not that Manson Family.

Four dead babies, 1 a daycare child, the other 3 foster babies. It was 1994 in Washington State, the same year 7 month old Jesse Hunt who had been in the Edith Goetz daycare home died.

After interacting with unelected state bureaucratic managers for almost 2 decades are representatives, senators, the state auditor and his staff, the governor and the attorney general numbed out about the deaths of children? Are feelings repressed? Does one dissociate in order not to grieve?

Rep. Kagi is listed as a "child advocate and public policy consultant" in the February 4, 1995 Manson Fatality Review Committee report. This report was the reason the legislature strengthened RCW 74.15 in 1995 adding a clear "intent" to the law that the health, safety and well-being of your children in state care was paramount over the right of someone to get a daycare license.

For parents and the public out there in readership land the "intent" gives assistant attorneys general, administrative law judges, superior court judges, appellate court justices and supreme court justices a heads up as to just what the legislature intended in passing the law.

The report recommended: "Regular reports of child fatality reviews should be made available to...licensors to increase their understanding of risks for children for whose well-being they are responsible." The unelected bureaucratic managers never did that in the 13 years I was a licensor.

In 2004, 2 year old Hailee Rhodes was slammed down in the playpen by licensed daycare provider Danette Zaring. Hailee suffered brain damage. I brought a card to our regional meeting and asked the managers if they would pass it around for the licensors and supervisors to sign to send to Hailee. They said no.

January 27, 2005 and February 9, 2005 I testified before Rep. Kagi's children's services committee about managers removing information from files, destroying records and not investigating applicants as required per RCW 74.15.030(2)(3)(b). I gave her a copy of a packet I found in a notebook from 2002 when I  conducted the background clearances on applicants in Vancouver DSHS office. I discovered in 2005 it had been removed from the Jennifer Jones licensing file.

Rep. Kagi merely turned around and gave it to director Rachael Langen. The 1994 Manson Fatality Review report stated: "high priority must be given to formation and maintenance of files so that information is complete, easily accessible and useful..."

From 2002 when Christine Gregoire was attorney general to this present moment in 2011 with Rob McKenna as attorney general I have tried to get an official opinion on the record from these two top elected officials about unelected bureaucratic managers concealing, removing and destroying records in violation of the law.

Why won't they go on the record? Why didn't they and why didn't State Auditor Brian Sonntag investigate the concealing, removing and destroying records allegations I reported through the whistle blower program in 2002 and 2005 as well as up my chain of command; and through the House and Senate? It's a class C Felony. 

The management mind set in 1994 that led to the deaths of those 4 unnamed babies and 7 month old Jesse Hunt continued to be the management mind set I witnessed through most of my 13 years as a daycare licensor. More about that in another article I will write.

In 2003 I had a good supervisor who allowed me to follow the law; and he didn't conceal, remove, didn't order records to be rewritten how he wanted them nor did he destroy records.

From 1989 in DSHS until towards the end of 2001 I had never been ordered to rewrite a record (whereby then the supervisor had the original destroyed).  2001 was the turning point.

Currently, the public disclosure process being done by the child care licensing agency, the Department of Early Learning (DEL), is centralized out of headquarters and is being done with integrity. And I just learned that licensing files on revoked licenses are required to be kept for 35 years. I have not been able to learn who made the request to the records retention committee which I would like to know as I want to give credit and kudos when high quality practices are done within the government agency.

Are we overwhelmed with guilt and grief about the many children who have been treated meanly, horribly injured and those that died...that forgetfulness, numbness and denial prevent the running of government as required by RCW (efficiency, effectiveness and economy) and we ignore what is paramount in day care licensing which is the health, safety and well-being of the child?

Is Rep. Kagi protecting herself from those feelings?
